… Respondents THE HON’BLE SHRI JUSTICE SANJAY KUMAR WRIT PETITION NO.22159 OF 2004 O R D E R By way of this writ petition, the petitioner assailed the dismissal of his revision by the Joint Collector, Kadapa District, under order dated 09.10.2004. The said revision was filed under Section 9 of the Andhra Pradesh Rights in Land and Pattadar Pass Books Act, 1971.
This Court, while admitting the writ petition on 02.12.2004, directed status quo obtaining as on that day to be maintained until further orders.
It is an admitted fact that a suit, O.S.No.318 of 1999, was filed by the petitioner herein before the learned Junior Civil Judge, Badvel, for declaration of his title and for a permanent injunction. This suit is stated to be still pending. As per Section 8(2) of the Andhra Pradesh Rights in Land and Pattadar Pass Books Act, 1971, the revenue authorities would be bound to implement the orders of the competent civil Court and carry out mutation in terms thereof. In that view of the matter, no direction can be given in this writ petition at the present stage. The parties would necessarily have to await the adjudication of the pending suit and thereafter seek mutation in the revenue records in terms thereof.
With the above observation, the writ petition is closed. Pending Miscellaneous Petitions, if any, shall also stand closed. No order as to costs.
