JUDGMENT / ORDER

1.0 Rule was issued yesterday. Learned Additional Public Prosecutor Mr. Patel made available for perusal the Jail Remarks and also a statement of the complainant side. The convict is undergoing seven years' imprisonment for the offences punishable under Sections 376, 366, 363 in Sessions Case No. 34 of 2011 by judgment and order 20th December 2011. He has undergone 10 months and 28 days as on date.
2.0 Taking into consideration the contents of the application and the fact that his cousin (daughter of uncle) is getting married on 19/05/2012, the application is allowed. The convict is ordered to be released on Temporary Bail for a period of 15 days from the date of his release, on his executing a personal bond of Rs.5,000/- (Rupees Five Thousand only) to the satisfaction of the jail authorities.
2.1 The learned Additional Public Prosecutor requested that as he is being released for the first, stricture condition may be imposed.
2.2 The convict is directed to report to the nearest Police Station between 9:00 a.m. to 2:00 p.m. on every alternate day.
2.3 The convict shall surrender to the jail authorities on expiry of the Temporary Bail period.
2.4 Rule is made absolute to the aforesaid extent.
