JUDGMENT / ORDER

Rule.
MR.Maulik Nanavati, learned Additional Public Prosecutor waives service of Rule for the respondent-State.
The applicant-convict forwarded the application through jail seeking parole leave for 20 days on the ground of attending marriage in his family as well as after death ceremony of his mother in law.
Considering the order passed by the District Magistrate, Kutch-Bhuj, dated 05th May,2012, it transpires that the request for parole leave came to be turned down on the ground that the police report was adverse and there was likelihood of breach of peace and tranquility. Considering the jail remarks sheet, it transpires that on number of occasions from the year-2003 up to 23.12.2011, the applicant convict came to be released either on temporary bail or parole leave or furlough leave and on every occasion, he surrendered in time and nothing emerges that during his absence from jail any untoward incident occurred.
For the foregoing reasons, the application is partly allowed and the applicant is ordered to be released on parole leave for the period of two weeks from the date of his actual release on his furnishing personal bond of Rs.5,000/- with one surety of like amount to the satisfaction of concerned Jail authority. On completion of period of parole leave, he shall immediately surrender before the Jail authority and during the period of his parole leave, he shall maintain law and order and shall not misuse his liberty.
Application stands disposed of. Rule made absolute accordingly. Direct service is permitted.
