Heard Sri Nitesh Kumar Srivastava, learned counsel for the petitioner, learned Standing counsel for the State-respondent and Sri Rishikesh Pati Tripathi, learned counsel for the respondent no.4.
By means of the present writ petition, the petitioner seeks a direction in the nature of mandamus commanding the respondent no.3/ Tehsildar, Tehsil- Bhatpar Rani, District- Deoira to decide the Mutation Case No.01588 of 2020, Computer Case No. T202005200501588 filed under Section 34 U.P. Revenue Code, 2006 within a stipulated period of time.
Learned counsel for the petitioner submits that mutation proceedings is pending since 2020. The sole prayer has been made to conclude the pending proceedings at the earliest.
Learned Standing counsel submits that no useful purpose would be served to keep the writ petition pending and suitable direction may be issued by this Court to the authority concerned for deciding the same in time bound manner.
In the facts and circumstances of the case, direction is issued upon respondent no.3/ Tehsildar, Tehsil- Bhatpar Rani, District- Deoira to decide the Mutation Case No. T202005200501588 filed under Section 34 U.P. Revenue Code, 2006 in accordance with law expeditiously, preferably within a period of six months from the date of production of a certified copy of this order.
With the above direction, the writ petition stands finally disposed of. No order as to costs.
