Heard learned counsel for the applicants as well as learned A.G.A. and perused the record.
This application under Section 482 Cr.P.C. has been filed for quashing the entire proceedings of Complaint Case No. 205 of 2003, under Sections 3/4 of D.P. Act, Police Station- Karchhana, Allahabad, pending in the Court of A.C.J.M. Court No.11, Allahabad.
Learned counsel for the applicants states that matter has been compromised between the parties but compromise-deed could not be prepared.
Since the offence under Section 3/4 of D.P. Act is compoundable one and the trial Court itself is empowered to pass appropriate order in terms of compromise arrived at between the parties.
In view of the above, the applicants are directed to move appropriate application along with compromise affidavit before the trial Court which shall be considered and decided by the trial Court in accordance with law.
The application stands disposed of accordingly.
