Heard learned counsel for the applicant and learned A.G.A for the State and perused the material available on record.
The present bail application under Section 439 Cr.P.C has been filed by the applicant in Case Crime No. 72 of 2016, under Sections 420, 409 I.P.C, Police Station - Sipri Bazar, District - Jhansi, with the prayer to enlarge him on bail.
Learned counsel for the applicant contended that the amount of Rs.4,04,980/-is said to have been embezzled by the applicant -Makrand Singh Tomar, who was the Cashier while acting in connivance with Sri Arvind Narain Nimje. The applicant is retired person and is in jail for about three months. Although counsel for the applicant denies the allegations against the applicant, but for the purpose of bail, he is ready to comply with any condition imposed by the Court.
Considering the fact that the applicant is a retired person, whose name had surfaced during inquiry after his retirement and departmental proceedings are still pending, he may be released on bail on certain conditions, Let the applicant - Makrand Singh Tomar, be enlarged on bail in the aforesaid case crime number on his furnishing a personal bond and two reliable sureties of the like amount to the satisfaction of the court concerned after furnishing of Rs.2,00,000/- in cash in court. This amount will be disposed of by the court concerned after conclusion of investigation / trial.
