1. Heard learned counsel for the petitioner and Sri Kaushal Kishore Mani, learned counsel for the Gaon Sabha.
2. Petitioner claims to have been allotted residential lease to construct a dwelling house on abadi land. However, his possession is claimed to have been disturbed by certain private persons. In that regard, petitioner appears to have filed an application referable to Sections 125 and 129 of the UP Revenue Code, 2006 before respondent no.3 on 20.10.2020. The petitioner is thus claiming relief of restoration of possession with respect to the lease land.
3. Without entering into the merits of the case, the present writ petition is disposed of with a direction to respondent no.3 to decide the aforesaid application, as expeditiously as possible, strictly in accordance with law, preferably within a period of three months, after affording due opportunity of hearing, if there is no other legal impediment and further if petitioner does not seek any adjournment and cooperates in the hearing.
