High Court Of Gujarat|18 July, 2012

JUDGMENT / ORDER

The applicant/prisoner has taken-out this application for seeking appropriate direction as the application made by the prisoner/applicant to the State for exercising power under Section-433 (A) of Criminal Procedure Code, is rejected vide order dated 14/06/2012. The Court has perused the order rejecting the application. The order rejecting the application contains grounds that on early occasion, the applicant/prisoner had absconded for 1437 days, when he was released on parole. There is adverse opinion of the Advisory Committee and during the time of absconding he was involved in Crime Registered No.99/98 under the Arms Act, which resulted into conviction and imposing of penalty and punishment of 3 years and fine of Rs.500/-. In light of these grounds for rejection, even this Court is of the considered view that the rejection is correct and this Court need not entertain the application. Hence, the present application is rejected. The applicant/prisoner be informed accordingly.
