1. The present application is filed for condonation of delay of 287 days in preferring First appeal (stamp number) 819 of 2012 against the judgement and award passed by the Tribunal in MACP No. 458 of 1997. Considering the facts and circumstances, it appears that even if the delay is to be leniently viewed, the applicants are required to compensate the respondent for the delay. Considering the facts and circumstances, appropriate cost could be of Rs. 1,000/- for each of the Respondents i.e. total Rs.3,000/-.
2. Hence, the delay is condoned on the condition that the applicants pay the cost of Rs.1,000/- to each of the respondent total Rs.3,000/- within two weeks from today or deposit with this Court. After the amount of cost is deposited, it would be open to respondents to withdraw the amount of costs from this Court either directly or through their authorized representative. After the amount is deposited and paid the conditions shall stand complied with and the applicants shall be at the liberty to move for hearing of the first appeal. Application is allowed to the aforesaid extent. Rule made absolute accordingly.
