Heard learned counsel for the applicants and the learned A.G.A.
This application is filed by the applicants for quashing the entire criminal proceeding as well as the charge-sheet dated 13.12.2006 in Case No.68 of 2007 (State Vs. Maan Singh), under Sections 323, 325 IPC arising out of Case Crime No.292 of 2006, P.S.-Pilakhua, District Ghaziabad, pending in the court of Chief Judicial Magistrate, Hapur.
After arguing at some length, learned counsel for applicants submits that grievance of applicants would be sufficiently met in case bail application of applicants is considered expeditiously in accordance with law.
In view thereof, it is provided that if the applicants surrenders before the Court below within two weeks from today and applies for bail, the Court below will consider the same, in accordance with law in view of the observations made in the case of Lal Kamlendra Pratap Singh Vs. State of U.P. reported in [2009 (3) ADJ 322 (SC)].
For a period of two weeks, no coercive steps shall be taken against the applicants.
With the aforesaid, the application is disposed of.
