ORDER:
This Writ Petition is filed for a mandamus to declare the inaction of respondent No.3 in considering the petitioner’s request for shifting of his saw mill from Omer Nagar, Amberpet, Hyderabad to Ponugutivalasa village, Srikakulam District, Andhra Pradesh.
Mr. P. Sridhar Rao, learned Counsel for the petitioner, submitted that the request of the petitioner for permission to shift the saw-mill was positively recommended by respondent No.5 to respondent No.6 vide his proceedings dated 20-11-2013 and that respondent No.3 has not taken action so far.
At the hearing, it has come out that respondent No.3 is a functionary of the Government of the State of Telangana. As the petitioner wants to shift the saw mill from the State of Telangana to the State of Andhra Pradesh, it may not be necessary for the petitioner to seek permission of the Government of Telangana as it is only the Government in whose territory the saw-mill is sought to be shifted that needs to grant permission. As the petitioner has no grievance with regard to the functionaries of the Government of the State of Andhra Pradesh, I do not find any reason to issue a direction to respondent No.3 to consider the petitioner’s request.
Subject to the above observation, the Writ Petition is disposed of.
As a sequel to the disposal of the Writ Petition, WPMP No.43143 of 2014 filed for interim relief is disposed of as infructuous.
