Heard learned counsel for the applicant and learned A. G. A. for the State and perused the material on record.
By means of this application the applicant, who is involved in Case Crime No. 387 of 2015, under Sections-326-A, 302 and 34 IPC, P. S.-Lisari Gate, district- Meerut and is in jail, is seeking enlargement on bail during the trial.
Learned counsel for the applicant submitted that the role of sprinkling acid on the victim has been assigned exclusively to the co-accused Sajid, while the applicant and the other co-accused have not been attributed any overt act, hence, the applicant who is in jail and has no criminal antecedents to his credit, is entitled to be enlarged on bail.
Per contra, learned A.G. A. has vehemently opposed the prayer for bail and submitted that the specific allegation has been made against three persons including the applicant that they climbed on the roof of the victim and sprinkled acid on the six family members of the victim, hence the applicant is not entitled to be enlarged on bail.
Considering the gravity of he offence and the specific role assigned to the applicant and the other co-accused, the applicant is not entitled to be enlarged on bail.
Accordingly, this application is rejected.
However, considering the peculiar facts and circumstances of the case, it is directed that the court concerned shall conclude the trial of the aforementioned case as expeditiously as possible, preferably within a period of four months from the date of production of certified copy of this order without granting unnecessary adjournments to either of the parties, if there is no legal impediment.
