Learned counsel for the applicant has not made compliance of the order passed by this court on 19.3.2021. Thereafter, learned counsel for the opposite party no. 2 has filed Criminal Misc. Stay Vacation Application No. NIL of 2020 and this court vide order dated 15.9.2021 allowed the aforesaid stay vacation application and vacated the interim stay order on the ground of non depositing the amount of Rs. 4000/- per month.
Today, when the case was taken up, learned counsel for the applicant has sought further time for compliance of the order dated 19.3.2021.
Sri Sunil Kumar Dubey, learned counsel for the opposite party no. 2 opposed the aforesaid request made by learned counsel for the applicant and submits that the applicant has not deposited any amount as directed by this court vide order dated 19.3.2021 and he is only lingering the matter on one and the other grounds.
After considering the arguments as advanced by the learned counsel for the parties and after perusal of the record, this court finds that the court below has rightly passed the order dated 02.02.2021 by which the applicant was directed to pay Rs. 5000/- per month to her wife as maintenance and in the period of price hike, the amount awarded by the court below appears to be justified and proper and further the applicant has not made compliance of the order dated 19.3.2021, therefore, this Application u/S 482 deserves to be dismissed.
Accordingly, this Application u/S 482 lacks merit and is dismissed.
However, the court below is directed to proceed in the matter expeditiously in accordance with law without granting any unnecessary adjournment to either of the parties, unless there is some legal impediment or unless there is any order passed by the higher court staying the proceedings of the case.
