This anticipatory bail application under Section 438 Cr.P.C. has been moved seeking the bail of applicant-Mainuddin Khan @ Rinku in the event of his arrest in Case Crime No.862 of 2020, under Sections 498-A, 323, 504, 506, 427, 452, 392 I.P.C.
and Section 3/4 Muslim Women (Protection on the Right of Marriage) Act, 2019, Police Station Cantt., District-Varanasi.
Heard learned counsel for the applicant, learned counsel for the opposite party no. 2, learned A.G.A. for the State and perused the material available on record.
Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in the present case. He has committed no offence. It is further submitted that the applicant is the husband of opposite party no. 2 and marriage between them was solemnized in the year 2007. There is general allegation against the applicant and others family members. He further submits that if the applicant is enlarged on anticipatory bail, he shall not misuse the liberty of bail and would co-operate with the investigation.
Learned AGA as well as learned counsel for opposite party no. 2 vehemently opposed the application and submitted that there are five injuries on the person of victim.
Having regard to the submissions made by learned counsel for the parties, the applicant being husband of opposite party no. 2 and allegation made against the applicant, I do not find any good ground to release the applicant on anticipatory bail.
Accordingly, the anticipatory bail application is rejected.
