Heard Sri Raj Narayan Tiwari, learned counsel for the petitioners, Sri Anjali Upadhya, learned counsel for the respondent no. 3 and 4, learned Standing Counsel for the State-respondents and perused the record.
Learned counsel appearing on behalf of respondent no. 3 and 4 states that the petitioners want to have an agreement for sale of the land bearing Khata No. 325, Khasra No. 736 measuring area - 0.3553 Hectare, but no such agreement has been arrived between the parties and, as such, there is no question of executing any sale- deed in this regard. Consequently, there is no question of taking over possession of the land in question, forcibly or otherwise, and, as such, no cause exists in the matter.
In view of the definite statement given by learned counsel appearing on behalf of respondent no. 3 and 4, the writ petition is dismissed there being no cause to be adjudicated.
