Heard learned counsel for the parties and perused the material brought on record.
It is contended by learned counsel for the applicant that applicant has been falsely implicated in the present case due to ulterior motive.
Learned A.G.A. and learned counsel for the first informant/complainant have vehemently opposed the prayer and submitted that applicant along with co-accused compelled the victim for prostitution and on refusal for the same they used to beat her brutally by giving electric shock, all the brutality done by the applicant and co-accused against the victim are itself explicit from a perusal of the statement of the victim. The applicant has previous criminal history of seven cases.
After hearing the learned counsel for the applicant, learned counsel for the first informant/complainant as well as learned A.G.A., and after perusing the averments made in the present bail application this Court is of the opinion, that learned counsel for the applicant could not point out any good ground for grant of bail to the applicant.
Accordingly, application for grant of bail to the applicant- Maina alias Tulsi wife of Late Mehtab, who is involved in Case Crime No. 99 of 2019, under sections- 363, 342, 370, 372, 373 IPC and Section 4, 5, 6 and 7 of the Immoral Traffic Prevention Act, Police Station- Manduadeeh, District - Varanasi, is hereby rejected.
However, considering the facts and circumstances of the case, it is expected that the court concerned shall conclude the trial expeditiously preferably within a period of six months if possible, from the date of production of a computer generated copy of this order, if there is no legal impediment.
The party shall file computer generated copy of such order downloaded from the official website of High Court Allahabad. The concerned Court shall verify the authenticity of such computerized copy of the order from the official website of High Court, Allahabad.
