HONOURABLE SRI JUSTICE S.RAVI KUMAR CRIMINAL PETITION No.4094 OF 2012 ORDER:
This petition is filed to quash proceedings in C.C.No.9 of 2012 on the file of Additional Judicial First Class Magistrate, Vizianagaram for alleged offences under Sections 498-A IPC and 3, 4 and 6 (2) of Dowry Prohibition Act.
Heard both sides.
The main objection of the petitioners is that the court at Vizianagaram has no jurisdiction since entire alleged harassment and the incident took place at Chennai. He further submitted that second petitioner and third petitioner are nothing to do with the alleged harassment and they are implicated because of their relationship with the husband of the de facto complainant.
Advocate for second respondent submitted that in this case, trial is completed and the matter is at the stage of 313 Cr.P.C. examination before the trial court and at this stage, quashing the proceedings is not proper.
I have perused the material papers filed along with the quash petition.
The objections raised on behalf of petitioners including the jurisdiction aspect can be urged before the trial court. By directing the trial court to consider these grounds without being influenced by the dismissal of this quash petition, this petition can be disposed of. Since the matter is at the stage of 313 Cr.P.C. examination, I hope that the court below will decide the matter as expeditiously as possible.
With the above observation, this Criminal Petition is dismissed.
As a sequel to the disposal of this Criminal petition, the Miscellaneous Petitions, if any, pending, shall stand dismissed.
