Heard learned counsel for the petitioner and Sri Sujeet Kumar Rai, learned counsel for respondent nos. 3 & 4.
Pursuant to the order of this Court dated 10.12.2021, Sri Jagdish Chandra, Secretary & Chief Executive Officer, District Cooperative Bank Limited, Ballia, respondent no. 3 has filed his personal affidavit in the Court today, which is taken on record. It is stated in para 5 of the affidavit that a sum of Rs.3,86,898/-, which was illegally withheld, has been paid to the petitioner vide cheque no. 010644 dated 16.12.2021, copy of which is appended as annexure-1 to the affidavit.
So far as the other claims are concerned, Sri Sujeet Kumar Rai has placed a letter dated 17.1.2020 issued by the Commissioner & Registrar, Cooperative Societies, U.P., Lucknow before this Court wherein it is stated that the respondent bank will make payment of post retiral dues to the retired employees in four quarterly instalments.
Considering the facts and circumstances of the case and the statement made by learned counsel for the respondent bank, the writ petition is disposed of directing the the respondent no. 3 - Bank to make payment of all retiral dues to the petitioner in four quarterly instalments.
Personal appearance of respondent no. 3 is exempted.
