This application has been preferred by the applicant for quashing the order dated 13.11.2018 in Case No. 924 of 2018 relating to case Crime No. 881 of 2015 under Section 307 IPC at Police Station Devband, District Saharanpur pending in the court of Additional Chief Judicial Magistrate, District Saharanpur.
This is the second application under Section 482 Cr.P.C. In the first application under Section 482 Cr.P.C No. 18543 of 2018 prayer for quashing of the entire proceedings of the aforesaid criminal case was refused and the applicant was directed to surrender before the court below within 30 days. It appears that the applicant has not complied with the order dated 1.6.2018 and has again approached this Court.
Keeping in view the conduct of the applicant, the prayer made in the application cannot be granted.
Accordingly the application is dismissed.
