It is informed that 45 similar writ petitions, pending at Allahabad have been listed on 8th March, 2010 for final hearing, wherein the arrest of the petitioners have been stayed till the aforesaid date.
On behalf of the petitioners, it is submitted that Sri Gaurav Bhatia, learned counsel for the petitioners is not available today.
On the previous occasion i.e. on 22.01.2010, on an undertaking given by the Advocate General, U.P. it was directed that the petitioners in the crime number, shall not be arrested till 27.01.2010, since there is every likelihood that the aforesaid matters pending at Allahabad might be heard and disposed of by the said date.
In view of the latest developments, as indicated herein above, let this case be listed on 11.03.2010 for final hearing, as requested. Counter affidavit and rejoinder affidavit may be exchanged in the meanwhile.
Having regard to the above, as an interim measure, it is directed that till the aforesaid date, the petitioners (Mahtab Singh, Ashok Kumar Gupta, Shishir Bajaj & Kushagra Nayan Bajaj) shall not be arrested in Case Crime No. 12 of 2010, under Sections 420, 418, 120-B I.P.C., Section 22 of the U.P. Sugarcane (Regulation of Supply and Purchase) Act, 1953 and U.P. Sugarcane (Regulation of Supply and Purchase) Rules, 1954, Section 3A of Sugarcane (Control) Order, 1966, Section 8 of U.P. Vacuum Pan Sugar Factories Licensing Order, 1969 and 3/7 E.C. Act, Police Station Gola, District Kheri, subject to their full co-operation in the investigation, which shall go on.
