Heard learned counsel for the parties.
The present writ petition is directed against the ex-parte order dated 8.3.2018 passed by the State Information Commissioner, Uttar Pradesh Information Commission, Lucknow.
At the outset, learned counsel for the respondent no. 1 submits that Rule 12 of the Rules namely U.P. Right to Information Rules, 2015 framed under Section 27 of the RTI Act, 2005, the petitioner has a remedy to file a recall application.
In view of the aforesaid, the present writ petition is being disposed of with the observation that it is open for the petitioner to move a recall application under Rule 12(1) of the U.P. Right to Information Rules, 2015.
The delay in filing the recall application is hereby condoned.
The State Information Commissioner is directed to entertain the application and decide the same on merits by passing a reasoned and reasoning order, in accordance with law.
