Heard learned counsel for the parties and perused the record.
This application under Section 482 of the Code of Criminal Procedure, 1973 (in short 'Code') has been filed on behalf of the applicants with a prayer to quash the entire proceedings of Case No. 755 of 2016, Charge Sheet No. 0177 of 2016 (State v. Mahmood and others) arising out of Case Crime No. 29 of 2016, under Sections 420, 406, 504 and 506 of the Indian Penal Code, 1860 Police Station - Deoband, District - Saharanpur.
Joint affidavit of applicant no. 1 - Mahmood Ali and opposite party no. 2 - Irshad Sagar with the assertion that the parties have amicably settled the matter through mediation.
This is a case of matrimonial dispute between the parties.
In view of law propounded by Hon'ble Apex Court in the case of Social Action Forum for Manav Adhikar and another Vs. Union of India reported in 2018 SCC OnLine SC 1501, the proceedings in the aforesaid case is quashed.
