Heard Sri Prakhar Tandon, learned counsel for petitioners, learned Standing Counsel for respondent no. 1 and Sri Sunil Kumar Mishra, learned counsel for U.P. State Road Transport Corporation.
This petition has been filed by the petitioners seeking direction upon respondents to release the post retiral benefits as payable to the petitioners.
Petitioners who are five in number were appointed as drivers and posted in Jhansi. They worked in Jhansi till their retirement. After retirement, petitioners had claimed retiral dues which was rejected on the ground that they are only entitled under Regulation 39(2) of Uttar Pradesh State Road Transport Corporation Employees Service Regulations, 1981. It has been contended on behalf of petitioners that they had been paid their EPF and part of gratuity, but the balance amount of gratuity has not been released by concerned department.
In view of the statement so made, petitioners are directed to make an application before respondent no. 3 within 15 days from today who shall decide the claim of petitioners in regard to balance amount of gratuity payable under Regulation 39(2), in accordance with law, by reasoned and speaking order within three months from the date of production of certified copy of this order.
With the above observation and direction, the writ petition stands disposed of.
