Heard.
In view of the averments made in the application, and in view of the decision of the Hon'ble Apex Court in the case of Mahadev Govind Gharge & Ors. v. Special Land Acquisition Officer, Jamkhandi, Karnataka reported in (2011) 6 SCC 321, the litigant should not suffer on account of lapse on the part of the lawyer. On the facts and circumstances of the case sufficient cause is shown to condone the delay. The delay is, therefore, condoned and the application is granted. The application stands disposed of accordingly. It is however, clarified that if ultimately the cross objections are allowed, the interest will be calculated from today.
