JUDGMENT / ORDER

Hon'ble Vishnu Chandra Gupta,J.
Heard Sri Akhilesh Pandey, learned counsel for the petitioner and learned Standing Counsel for the State.
With the consent of the parties' counsel, the writ petition is being finally disposed of at admission stage itself.
The petitioner had taken a loan for the purpose of purchasing a Truck , but he could not repay the amount of loan in installment as per agreement. In these circumstances recovery of citation has been issued against the petitioner.
The petitioner's counsel states that the petitioner is ready to pay the dues but in easy installment to which learned counsel appearing on behalf of respondents have no objection.
Accordingly, the writ petition is finally disposed of directing the respondent Bank to furnish statement of account to the petitioner within 15 days from today and thereafter the petitioner is permitted to deposit all outstanding dues in three equal quarterly installments, the first of which shall fall due in the month of December, 2012.
In case of default in payment of all or any installment, as stipulated above, it shall be open to the respondents to proceed with the recovery proceedings in accordance with law.
Subject to above, the writ petition is finally disposed of.
