Mahipatsinh vs State

For the serious offence registered under Sections 363, 366, 376 of Indian Penal Code and also under Section 3(2) and 5 of Atrocity Act and when the charge-sheet is filed, powers to quash the proceedings impugned cannot be exercised under Section 482 of the Code of Criminal Procedure, 1973.

The application is misconceived and accordingly rejected.
