Heard learned counsel for the petitioner and learned Additional Government Advocate.
By means of this petition, the petitioner has prayed for quashing First Information Report relating to Case Crime No. 345 of 2010 under Sections 323, 504 & 506 IPC read with Section 3 (i) (x) SC/ST Act of Police Station Itaunja, district Lucknow.
We have gone through the contents of the writ petition as well as the First Information Report. From a perusal of the First Information Report, prima facie, commission of cognizable offence against the petitioner is made out, as such, the same cannot be quashed.
However, considering the facts and circumstances of the case, we direct that the petitioner shall not be arrested in the above mentioned case crime number till submission of report under Section 173(2) Cr.P.C. before the Court concerned. Investigation shall go on and the petitioner shall cooperate in it.
Subject to the above observations/directions, the petition is finally disposed of.
