Sri Dinesh Kumar Singh, learned counsel appearing on behalf of the appellant no. 2, Satypal is present.
The report of the Chief Judicial Magistrate, Saharanpur indicates that the appellant no.1 Mahipal Singh has expired on 16.01.2017. The inquiry was conducted with respect to the death of the appellant no.1 Mahipal Singh as per circular of this Court, hence the appeal on behalf of the abovementioned appellant has lost its efficacy.
Accordingly, the appeal on behalf of the appellant no.1 Mahipal Singh stands abated.
Since the lower court record has already been received, the office is directed to proceed to prepare the paper books within six weeks. Copy of the paper books be supplied to the learned counsel for the parties as per Rules.
List thereafter for final hearing before the appropriate Bench.
