Heard Mr. Bal Krishna Pandey, learned counsel for the applicant, learned AGA for the State and Mr. S.D. Singh Jadaun Advocate, who has put in appearance on behalf of the complainant by filing his Vakalatnama in Court today, which is taken on record.
After some argument, it transpires that in the FIR dated 31.12.2017 no person was named as an accused. Subsequently, on the basis of the material which came to the knowledge and custody of the investigating officer, six persons were nominated as the accused in the aforesaid FIR. Of the six persons so nominated as the accused, three persons namely, Mahipal Singh (Father-in-law), Vidya (mother-in-law) and Lalit (husband) of the deceased have surrendered to the process of the Court. However, the other three accused namely, Smt. Vijay, Amit Kumar and Bhagwan Das have not yet surrendered to the process of the Court, even when there is no order passed by any court staying their arrest. In view of the facts as noted herein above, the hearing of the present bail application is deferred to 31.1.2019.
Let the remaining accused persons appear before the Court below on or before 30.1.2019. On the next date learned counsel for the applicant shall file a supplementary affidavit stating therein that remaining accused have surrendered to the process of the Court. It is only when the aforesaid exercise is undertaken that the hearing of the present bail application shall be undertaken by this Court.
Put up as fresh on 31.1.2019.
