The instant petition has been filed for a direction upon the court concerned to decide application 6-C pending in Suit No.84 of 2018 within a stipulated period.
From the order sheet of the suit it appears that on 28.03.2018 consideration of the interim injunction application was deferred till service of notice upon the other side. It is not clear from the order sheet whether the other side has been duly served with notice of the proceedings.
Under the circumstances, in case the other side has been duly served with notice of the proceeding and the application 6-C is still pending, it would be appropriate that the petitioners move an application before the court concerned for consideration of such pending application. It is expected that if other side is served with notice of the proceeding and there is urgency, the court concerned shall accord due consideration to the application 6-C.
With the aforesaid observation/liberty, the petition is disposed off.
