This defective appeal was presented on 6.1.2010. The Stamp Reporter has recorded 102 days delay. The case was taken up on 5.1.2010, 21.1.2010 and on the request of learned counsel for the appellant this case came up for hearing on admission. Through the impugned order passed by the first appellate Court, the matter has been remanded back to the trial court for reconsideration. The appellalte court has categorically stipulated that the trial court within 3 days shall take up the evidence and dipsose of the matter expeditiously. This order was passed on 23.5.2009 about 1 1/2 years ago. It appears that the trial must have been completed by now as no interim order was passed by this Court.
Learned counsel for the appellant wants adjournment to the case. Let the case be adjourned for 16.2.2010. It is made clear that no interim order has been passed by this Court nor any substantial order has been passed for entertaining the defective appeal.
