Heard learned Counsel for the petitioner, Sri Rajiv Singh, learned Standing Counsel for the State- respondents and Sri Ashish Kumar Srivastava, learned Counsel representing respondent No.5.
In our considered opinion, this petition is misconceived and frivolous inasmuch as on one hand, the consumers want that the network of all the service providers should be strong and continuous and on the other hand, upon installation of towers, objections are being raised that the towers should be removed as they are hazardous to the health of the residents. None of the petitioners or the residents of the area are willing to surrender their mobiles and give an undertaking that they will not use the mobiles. In such circumstances, we do not find it a fit case to be entertained as Public Interest Litigation.
Petition is dismissed accordingly.
