1. Heard learned counsel for parties and perused the record.
2. Petitioner is seeking a writ of mandamus commanding respondents to allow him to join Special B.T.C. Training-2004 which is already over. Hence, by efflux of time this writ petition has rendered infructuous and is liable to be dismissed accordingly.
3. Further petitioner is claiming benefit pursuant to judgment of this Court in Upendra Rai vs. State of U.P. & others (2000) 2 UPLBEC 1340. However, during the pendency of this writ petition, the aforesaid Division Bench judgment of this Court has been reversed by Apex Court in appeal in Basic Education Board, U.P. Vs. Upendra Rai and others JT 2008 (2)SC 4792. Therefore, even otherwise no relief can be granted.
4. Dismissed.
