Heard learned counsel for the petitioners.
The only submission of the learned counsel for the petitioners is to direct the Civil Judge (Sr. Division)/Fast Tract Court, Varanasi to decide the Application 6C dated 30.10.2017 filed under Order 39 Rules 1 and 2 C.P.C.
In view of the aforesaid, it would serve no purpose to keep the petition pending, and therefore the petition is disposed of by directing the Civil Judge (Sr. Division)/Fast Tract Court, Varanasi to decide the Application 6C dated 30.10.2017 filed under Order 39 Rules 1 and 2 C.P.C. expeditiously, preferably within a period of three months from the date of production of certified copy of this order strictly in accordance with law.
It is clarified that this Court has not adjudicated upon the merits of the claim as raised by the petitioners in the present petition.
