Smt. Maheswari @ Bujjamma, W/o. E. Jaggaiah, Aged about 36 years, Housewife, R/o. Gadduru Village, Kurmai Post, Palamaner Mandal, Chittoor District & another .. Petitioners AND The Government of Andhra Pradesh, Rep. by its Principal Secretary, Revenue Department, Secretariat Buildings, Hyderabad – 500 022 & 5 others .. Respondents The Court made the following:
HON’BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.28680 of 2014 ORDER:
When the matter is taken up for consideration, learned counsel for the petitioner as well as the learned Standing Counsel for Wakf Board represent that the subject matter is covered by the decision of this Court in W.P.No.9938 of 2014.
2. Learned counsel for the petitioners submits that same proceedings which are assailed in this writ petition were challenged in the said writ petition and this Court held that all the proceedings are not valid in law.
3. For the reasons alike and recording the submissions of both the learned counsel, this Writ Petition is disposed of. The registration authorities are directed to entertain and process the documents presented by the petitioners vide Endorsement Nos.50 of 2014, dated 27.08.2014, 51 of 2014, dated 01.09.2014, in respect of the property of 1st petitioner bearing Plot No.2 in Survey No.963/5A, 2nd petitioner bearing Plot No.132 in Survey No.963/5A, situated at Palamaner Village and Mandal, Chittoor District, without insisting for No Objection from the Andhra Pradesh State Wakf Board to the effect that the said land is Wakf property. In the event the documents are found to fulfill the requirements of Registration Act, 1908 and the Indian Stamp Act, 1899, the registration authorities shall complete the registration formalities and release the documents in accordance with the due procedure. There shall be no order as to costs. Miscellaneous petitions pending in this writ petition, if any, shall stand closed.
