JUDGMENT / ORDER

IN THE HIGH COURT OF JUDICATURE AT MADRAS DATED : 22.03.2017 CORAM THE HONOURABLE MR. JUSTICE R.MAHADEVAN Crl.O.P.No.5657 of 2017 and Crl.MP.No.4233 of 2017 Criminal Original Petition filed under Section 482 Cr.P.C. to quash the criminal proceedings in Crime No.4 of 2017 on the file of the respondent police.
For Petitioner : Mr.A.Arasu Ganesan For Respondent : Mr.C.Emalias, Addl. Public Prosecutor ORDER Challenging the criminal proceedings initiated against the petitioner herein in Crime No.4 of 2017 on the file of the respondent police, the present criminal original petition has been filed.
2. Today, when the matter was taken up for consideration, learned Additional Public Prosecutor, on instructions, submitted that though the petitioner was arrayed as A3 in the FIR in Cr.No.4 of 2017 registered for the offences punishable under Sections 423, 467, 468, 471 and 506(i) IPC, after enquiry, the respondent police is not inclined to proceed with the case against him, but is inclined to proceed further in respect of other accused.
3. In view of the submission so made by the learned Additional Public Prosecutor, nothing survives for adjudication in this matter. Recording the said submission, the respondent police is directed to conduct enquiry and proceed further as against A1 and A2.
4. This Criminal Original Petition is disposed of accordingly.
Consequently, connected Miscellaneous Petition is closed.
