Heard Mr. Paul, learned advocate for the applicant - writ petitioner.
2. Present application has been taken out seeking below mentioned reliefs/direction:-
"(B) Your Lordships may be pleased to fix the date of final hearing of Special Civil Application No.7145 of 2004;
(C) Your Lordships may be pleased to pass such other and further reliefs as the nature and circumstances of the case may require and direct the opponents to pay regular wages and arrears of unpaid wages with appropriate interest."
3. Since the decision of the Commissioner is under substantial challenge in the proceedings taken out by the Union of India and the said petition is pending, the relief prayed for in para-3(C) cannot be granted at this stage.
4. So far as the relief prayed for in para 3(B) is concerned, it is noticed that the Court has admitted the petition vide order dated 20.12.2004. By the very same order, the Court also directed that the process may be made returnable in March-2005. The petitioner has, now, made request as contained in para3(B) of the application. The applicant has requested for out of turn hearing even prior to other petitions which are senior and old than present petition. It would, therefore, now, not be proper and just to allow out of turn hearing to the writ petition.
4.1 However, considering the fact that the Court has, considering the facts and circumstances of the case, already directed the office to make process returnable in March-2005, the registry is directed to take necessary action to list the matter in the cause list of Final Hearing, after taking the said direction dated 20.12.2004 in focus.
With the aforesaid observations and direction, present application stands disposed of.
