Learned advocate Mr. MA Barot on behalf of learned advocate Mr. Dhaval M. Barot, who has filed sick note, while making oral submissions, states that the appellant received the cheque return memo dated 3.11.2005 on the same day. It appears from the impugned Judgment that the Bank memos Exh-20,22 and 24 do not bear official mark. In order to ascertain the correct facts, R & P be called for from the concerned Court so as to reach this Court on or before 3.5.2012.
