1. Notice was issued to applicant to engage another counsel pursuant to order dated 25.01.2018, but notice has not been received back after service. None is present to press this application, even though called in revise. As such, this Court has no option but to proceed to decide the case.

3. It appears that by efflux of time either cause of action is no more surviving or for any other reason matter has rendered infructuous and that is why none is present to press this application.
