Mahendrasinh vs Bhankabhai

It is urged jointly by the learned advocates that in due compliance of the order of this Court, Application Exh.20 is heard by trial Court. This petition is sought to be withdrawn with a request to direct the trial Court to hear Application Exh.40 afresh, by giving opportunity to both the sides. Request is acceded to. Order impugned is set-aside and parties are relegated to the trial Court which shall decide the application Exh.40 on affording to both the sides, opportunity without being influenced by the outcome of this petition.

This petition stands disposed of.
