Heard Sri Kshitij Shailendra, learned counsel for petitioners, learned Standing Counsel for State-respondents and Sri Suresh C. Dwivedi, learned counsel appearing for respondent nos. 2 and 3.
According to the counsel for respondent nos. 2 and 3 the land of petitioners have yet not been acquired/purchased.
It is stated at bar by the counsel for petitioners that there is notification published in the daily newspaper dated 21.02.2021 whereby the acquisition of the land of the petitioners have been proposed. The petitioners want that they may be awarded compensation of Rs.40 Lacs per hectare as per the circle rate notified by the District Magistrate on 1.8.2020, which cannot be determined in the writ petition.
Learned Standing Counsel appearing for State-respondent and Sri Dwivedi, appearing for respondent nos. 2 and 3 vehemently opposed the prayer of the petitioners stating therein that the petitioners have liberty to approach the Land Acquisition Officer of the District concerned with regard to the determination of compensation as and when the acquisition of their lands are over.
In view of above, we cannot grant the relief as prayed for in the writ petition.
Accordingly, the writ petition being premature is dismissed at this stage.
