Heard Sri Kamal Krishna, learned Senior counsel assisted by Sri Pradeep Kumar, counsel for the applicant, learned A.G.A for the State and perused the record.
It is contended on behalf of the applicant that as per the prosecution case a Bolero vehicle No. WB 62B-2733 was recovered from the possession of the applicant and that the applicant could not produce the paper of the same. As per the prosecution case, the applicant along with other co-accused persons had confessed that these vehicles were stolen from West Bengal and brought to the place for the purpose of sale. It has been contended on behalf of the applicant that one Gulab Chandra and Harish Chandra had applied before the court of Additional chief Judicial Magistrate, court No.13, Jaunpur for release of the aforesaid vehicle on the ground that the said vehicle was registered and owned by them and that the police had lifted the vehicle from their house. It has been pointed out that by order dated 4.6.2012 passed by the Additional Chief Judicial Magistrate, Court No.13, Jaunpur, the aforesaid vehicle has been released in favour of Gulab Chandra and others. Certified copy of the order dated 4.6.2012 has been produced before the Court, which is taken on record. It has also been contended that the applicant has no criminal history. The applicant is in jail since 14.3.2012.
Learned A.G.A though opposed the bail, but could not disclose anything to the contrary.
Considering the fact and circumstances of the case, without expressing any opinion on the merits of the case, I find it to be a fit case for bail.
Let the applicant Mahendra Vijaipal Singh alias Pappu Patel involved in case crime No. Nill of 2012, under sections 41,411, 414, 419,420, 467,468 and 471 I.P.C, Police Station Line Bazar, District Jaunpur be released on bail on his furnishing a personal bond with two reliable sureties each in the like amount to the satisfaction of the court concerned.
