1. Order dated 25.11.2005 having been recalled vide order of date passed on Recall/Restoration Application, application is restored to its original number.
2. As requested and agreed by learned counsel for applicants, I proceed to hear and decide this case at this stage.
3. Heard Sri S.K. Chaturvedi, learned counsel for applicants and perused the material available on record.
4. This application under Section 482 Cr.P.C. has been filed with a prayer to quash order dated 14.03.2002 passed by learned Additional Sessions Judge, Court No. 3, Mathura in Revision No. 192 of 2001, Udai Bhan Singh vs. Mahendra Singh and Others.
5. The order passed by Sub-Divisional Magistrate, Mathura under Section 133 Cr.P.C. on 18.06.2001 has been set aside by Additional Sessions Judge, Court No. 3, Mathura vide order dated 14.03.2002 and it has directed Magistrate to proceed afresh in accordance with law, therefore, for all practical purposes, there is no order affecting the interest of applicants at this stage, hence, no interference is called for.
6. In view thereof, application lacks merit and is accordingly dismissed.
