Learned counsel for the accused-appellant and learned A.G.A. for the State are present.
Perused the office report dated 30.11.2021, which states that accused-appellant Mahendra Singh has died.
I have gone through the report of Chief Judicial Magistrate, Agra, which states that he has conducted the inquiry regarding the death of accused-appellant Mahendra Singh and has also recorded the statements of witnesses Megh Singh (CW-1), Naresh Kumar (CW-2), S.I. Kaushal Kishor (CW-3) regarding the verification of death of accused-appellant. He has also annexed the photocopy of death certificate issued by Government of U.P., death certificate issued by Gram Pradhan Komal Singh Sikarbar.
In view of above, it is proved that the accused-appellant Mahendra Singh has died. Accordingly, the appeal against him is dismissed as abated.
The accused-appellant was on bail during pendency of appeal, his bail bonds are cancelled and the sureties are discharged.
