Heard learned counsel for the applicant and learned A.G.A. for the State.
The present 482 Cr.P.C. application has been filed to set aside the impugned order dated 20.7.2018 passed by the Additional Sessions Judge/Fast Track Court No. 2, Ghaziabad in Misc. Case No. 205 of 2017 Mahendra Vs, Mamta and another under section 126(2) Cr.P.C. P.S. Kavi Nagar to the extent it relates to the payment of cost of Rs. 70,000/-.
Issue notice to the opposite party no. 2 to file counter affidavit within four weeks.
In the meantime, applicant shall deposit the amount of Rs, 35,000/- pursuant to the impugned order dated 20th July, 2018. This deposit shall abide by final result of this case.
In case, the aforesaid deposit is made no further recovery of the cost shall be made from the applicant and the learned court below shall made all endeavour to decide the case under section 125 Cr.P. C. within four months.
The application is finally disposed of.
