The petitioner by means of this writ petition has challenged the show cause notice dated 20.09.2018 (Annexure No. 1) in case No. 106 of 2018, under Section 3(1) U.P. Control of Goondas Act, P.S. Agauta issued by District Magistrate Bulandshahr.
We have been taken through the said notice. We find that general nature of material allegations are not disclosed in the said notice.
Learned A.G.A. states that no useful purpose would be served requiring him to file a counter affidavit and keep this petition pending before this Court and the same may be disposed of at this stage.
In view of the shortcoming in the notice, it is hereby quashed.
However, it will be open to the authorities concerned to issue a fresh notice.
