The present writ petition has been filed by the petitioner praying for a writ of mandamus commanding the respondents to re-fix the pay and pension of the petitioner as per the report of the 5th, 6th and 7th Pay Commissions.
It has been stated that no orders are being passed by the Director of Higher Education, Uttar Pradesh, Prayagraj on different representations filed by the petitioner for the said purpose.
The petitioner may file a fresh representation for the said purpose before the Director of Higher Education, Uttar Pradesh, Prayagraj i.e. respondent no.2 bringing to his notice all the necessary facts who on receiving the said application shall decide the same and take appropriate action, in accordance with law, within a period of six months from the date of filing of the representation.
It is clarified that the Court has not expressed any opinion either on the delay or on the maintainability of the claim of the petitioner for seeking implementation of different Pay Commissions to re-fix his pays and pension.
The writ petition is disposed of.
