Heard learned counsel for the petitioner and learned Standing Counsel for the State-respondents.
The writ petition has been filed seeking the following relief -
"i. issue a writ, order or direction in the nature of writ of mandamus commanding to the respondent Deputy Director of Consolidation to decide the review / recall application dated 19.06.2018 submitted by respondent Kali Charan in Revisin No.36/2013-14, Mahendra Singh Versus Kali Charan expeditiously within time bound period without any adjournment, to meet out the ends of justice and to allow the writ petition."
On a pointed query by the Court, counsel for the petitioner has submitted, after obtaining instructions from his client that in pursuance of the order sought to be recalled vide recall application dated 19.06.2018, the name of the petitioner has already been mutated in the revenue records.
Under the circumstances, there does not appear any justifiable reason why the petitioner, who is opposite party in the recall application may be in a hurry to get the same decided. Therefore, no direction is being issued to decide the restoration application of the opposite party in a time bound manner.
The writ petition is disposed of with the observation that the Court concerned may endeavour to decide the restoration application as expeditiously as possible without granting any unnecessary adjournment to any of the parties, thereto.
