No one appears for the petitioner. Shri Ramesh Kumar Shukla, Advocate, representing respondent No. 4 is present. However, the Court has perused the records.
The present writ petition has been filed against the orders passed by the consolidation authorities in proceedings registered under Section 41 of the Uttar Pradesh Land Revenue Act, 1901 (hereinafter referred to as, 'Act, 1901') accepting the claim of respondent No. 4 for settlement of boundaries.
It is apparent from the records that the orders were passed on the basis of a report of the Revenue Inspector, which was proved by the Revenue Inspector and after the courts have recorded a finding that the report was prepared according to the prescribed Rules and after informing the parties.
The findings recorded by the courts below are findings of fact based on evidence available on record and there appears no perversity in the aforesaid findings so as to occasion interference by this Court under Article 226 of the Constitution of India.
The writ petition lacks merit, and is, accordingly
dismissed.
