The grievance of the petitioners is that at the behest of the local M.L.A., the route of the canal which was originally fixed has been diverted.
In case the route has been diverted for no proper justification, the matter requires consideration and since it involves consideration of the record and the factual aspects, we direct the Commissioner (respondent No.2) to examine the records and after due verification, pass a reasoned order as to whether the original route of the canal has been diverted and if such diversion is warranted.
The Commissioner shall take the aforesaid decision in the light of the representation of the petitioners dated 20.07.2019 which has been filed as Annexure-11 to the writ petition. The decision shall be taken most expeditiously, if possible, within a period of six weeks.
